What is TRADEMARK CLASS 2

INTRODUCTION:

A trademark is a type of intellectual property consisting of a recognizable sign, design, or expression which identifies products or services of a particular source from those of others, although trademarks used to identify services are usually called service marks.

The Fourth Schedule to the Trademark Rules, 2002 lays down the different trademark classes. Trademark has a total of 45 classes and the manufacture of goods and services are grouped into different trademark classes. Each class requires a different trademark registration. This is a classification of almost 80,000 products and services and divided into two sections- Classes for Goods & Classes of Services. Thus, it gives the trademark registration process a definite structure. Accordingly, the applicant can choose the broad class under which their goods or service description falls. The trademark classification helps avoid this by allowing you to search for a prior trademark in the class that you want to register your trademark in India.

CLASS TWO OF TRADEMARK ACT:

Trademark Class 2 is for colorants, paints and the preparations which are used for the protection against corrosion of colorants, wood, mordants, metals which are in foil and also powder form used by painters, artist, decorators and decorators. This particularly includes thinners, thickeners, fixatives and siccatives for paints, lacquers and varnishes for industry, arts and handicrafts, colorants for beverages and foodstuff and the dyestuffs for clothing.

This Class does not include, in particular: unprocessed artificial resins, semi-processed resins; mordants for metals; laundry blueing; cosmetic dyes; paint boxes (articles for use in school); inks for stationery purposes; insulating paints and varnishes. If the mark is being used in commerce, then you must furnish a specimen of this mark as consumers see it .It is necessary for the specimen to show the mark as used on or in connection with the goods in commerce. A trademark specimen should be a tag, label, or container for the goods, or a display which is associated with the goods. A copy or any other reproduction of a specimen of the mark as used on or in connection with the goods is acceptable. In most cases, the label is an acceptable specimen, if the trademark is applied to the goods or the containers for the goods in Class 2 by means of labels. It is not acceptable if the mark shown is just used as a trade name and not a trademark. The proper method of trademark affixation is to stamp a trademark on the goods, the container, or on the labels or tags attached to the goods or containers.
