Grounds of Refusal

As per the trademark provision in India, a trademark can be registered only if it fulfils certain needs. The registrar can object to a trademark from being registered in some cases. Section 9 – Absolute Grounds of Refusal and Section 11 – Relative Grounds of Refusal of the Trademarks Act, 1999 states the situations when a mark cannot be registered.

The Absolute Grounds of Refusal Are:

  1. The mark lacks uniqueness: Right names/surnames, laudatory words, invented or random words.
               
  2. The mark is illustrative of the attribute of the goods or services
               
  3. The mark comprises exclusively of marks or signs which have become usual in the accepted practices of the trade: ISI Mark, UN.
               
  4. It is likely to deceive the public or cause confusion: Apple air conditioners.
               
  5. It comprises or contains scandalous matter
               
  6. Words whose use is forbidden under Emblems Act: Ashok chakra, Indian flag.
     

Relative Grounds of Refusal:

  1. If there is a probability of confusion between an already existing mark and the mark applied for.
               
  2. Identical or similar trademarks cannot be made registered even if the class is dissimilar, especially in the case of established trademarks.
               
  3. Likely to make deception or dilution of an existing mark.
     

These are the cases which show why a prior search of trademark names is of great value and an advised practice. It results in the saving of time and money of the applicant and the registry. Once registered, the trademark is valid for 10 years, after which to get the registration a renewal application has to be filed at the end of every 10 years.
